IDreamOfSpace Win a Trip to Space Competition

Information published by I Dream of Space Limited ("Promoter") on how to enter and prizes form part of these terms and conditions. Any entry not complying with these terms and conditions is ineligible to win the Prize.

Entry is open to people aged 18 years and over. Employees of the Promoter and their immediate families are ineligible to enter.

The competition commences 1st November 2011, and closes as the draw reaches 25,000 entrants. ("Competition Period").

Governing Law

These Terms and Conditions and any issues or disputes which may arise out of or in connection with these Terms and Conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with New Zealand law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the New Zealand courts to settle any such dispute or issues.

Eligible Entrants

Purchasers of a 'Space Poster of Excellence' from IDreamOfSpace or an authorised IDreamOfSpace reseller during the Competition Period will be automatically entered into the draw to win the Prize.

Entry is limited to one per Eligible Entrant for each Space Poster of Excellence purchased. Note that entries are based on the owner of the Space Poster of Excellence and not necessarily the purchaser of the Space Poster of Excellence.

The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process.

The prize ("Prize"): The Promoter will fund the winner to take a sub-orbital flight booked through a supplier of the Promoter's choice (valued at approximately US$95,000 - US$200,000, depending on selection of provider) up to a maximum of NZ$240,000 (incl GST). The Prize includes the following for the winner: return economy flight to the international airport closest to the point of departure for the sub-orbital flight, domestic transfers within the country of departure to and from airports and place of accommodation, accommodation for five nights, and main meals, up to a combined maximum of NZ$10,000 (incl GST). Redemption of Prize is subject to availability.

The winner must book the sub-orbital flight within 14 days of notification by the promoter indicating that flight dates are available. Air travel and accommodation will be arranged by the Promoter in conjunction with the winner once the sub-orbital flight date becomes known.

The winner is responsible for all other costs associated with accepting or redeeming the Prize, including without limitation, room service, spending money, insurance and transport to and from the Airport. By accepting the Prize, the winner acknowledges that the date on which the sub-orbital flight will depart is not known to the Promoter as at the date of this competition and may not be known to the Promoter or the winner as at the date of purchase of the sub-orbital flight ticket. It is anticipated that the sub-orbital flight will depart in 2014, however, the Promoter takes no responsibility for the winner being unavailable or unable to take the sub-orbital flight on the actual date of departure. In addition, the winner will be required to pass a medical test and successfully complete the required training to be eligible to take the sub-orbital flight.

Acceptance and Redemption of the Prize

Acceptance and redemption of the Prize is subject to:

  • the sub-orbital flight ticket supplier's standard terms and conditions;
  • the sub-orbital flight and air flight carriers' standard terms and conditions, including without limitation any conditions as to eligibility;
  • any applicable aviation authority requirements;
  • the winner successfully completing any medical tests or training requirements required by the sub-orbital flight carrier;
  • the winner holding a valid passport and necessary visas, and otherwise being eligible to travel to and within the country of departure for the sub-orbital flight.

The Prize draw will be conducted within 7 days of the end of the competition period. To determine the entrants, the Promoter will live-stream the use of random.org to pick a number between 1 and 25,000 – to be correlated to an appropriate line in a text file shared among the participants of the draw – the entrant who this number correlates to will win the Prize.

Potential winners will be contacted using their email address, as appropriate. If the Promoter is unable to make contact with any potential winner within 48 hours of being drawn, or a potential winner is either ineligible to win the Prize, or does not accept the Prize within seven days of notification, the Prize will be forfeited and another winner will be randomly drawn.

The winner may be required to provide proof of purchase of the Space Poster of Excellence and photographic personal identification, in each case to the Promoter's satisfaction in order to be awarded the Prize.

Where the winner drawn is not an individual, that winner must elect an individual within its organisation to accept the Prize, subject to that individual accepting these terms and conditions.

The Promoter may, at its sole discretion, permit the winner to nominate another Eligible Entrant to take the Prize providing the sub-orbital flight ticket has not been booked.

In order to accept the Prize, the winner must agree to accept these terms and conditions and sign a waiver of liability in a form provided by the Promoter. If a winner does not agree to accept these terms and conditions or sign the waiver of liability, the winner will forfeit the Prize and the Promoter will be entitled to draw a new winner.

The Prize is not transferable and cannot be taken as cash. The Prize value is correct at time of printing but no responsibility is accepted for any variation in the value of any component of the Prize. The winner is responsible for any tax or other duties that may arise as a result of accepting or redeeming the Prize or any component of it.

The winner agrees to participate in all publicity organised by the Promoter, including but not limited to, photographs and audio and/or visual recordings of the winner and the winner redeeming the Prize. The Promoter may accompany the winner and record the winner's experience from notification of winning the Prize to taking the sub-orbital flight. The winner irrevocably consents to the Promoter using their likeness, image and/or voice in any media worldwide for an unlimited period of time without remuneration, for the purpose of promoting this competition and redemption of the Prize, and promoting any products/services manufactured, distributed and/or supplied by the Promoter.

The Promoter is not liable for any loss or damage whatsoever that is suffered by any person, including but not limited to, direct, indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the Prize, except for any liability that cannot be excluded by law.

The Promoter's decision is final and no correspondence will be entered into. The Promoter reserves the right to extend, cancel or amend this competition at any time. If any component of the Prize becomes unavailable, the Promoter reserves the right to substitute the Prize with another prize of equivalent value.

The Promoter shall not be liable in the event that this competition or any part of it cannot operate as intended. Where any component of the Prize is to be provided by a third party, the Promoter shall not have any liability for any failure of that third party to provide that component of the Prize as intended (including without limitation on account of the winner failing to pass any medical or training tests, or to satisfy any other requirements to enable purchase of a ticket or travel to or on the sub-orbital flight), and shall not be obligated to provide any replacement Prize.

Space travel is not for everyone. The Promoter reserves the right to substitute an equivalent cash prize, in its sole and absolute discretion, if the winner is unwilling or ineligible to make the sub-orbital flight. The Promoter may also, at its sole discretion, hold another drawing to determine a replacement winner if the winner is deemed medically unfit by the provider to take the flight.
